Welcome to MandiKart! These Terms and Conditions ("Terms") govern your use of the MandiKart website, mobile application, and related services (collectively, the "Service"), which connects you to local food vendors ("Vendors") for food delivery exclusively within the Indian Institute of Technology (IIT) Mandi campus.
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
1. Scope of Service
1.1. Platform: MandiKart is a technology platform that acts as an intermediary, connecting users ("You", "User") with third-party food Vendors (e.g., restaurants, canteens, cafes) operating on or serving the IIT Mandi campus.
1.2. Geographical Limitation: The Service is strictly and exclusively available for ordering and delivery within the geographical boundaries of the IIT Mandi campus, including both the South Campus and the North Campus. Orders placed for delivery to any location outside of these defined areas will not be processed.
1.3. Our Role: MandiKart does not prepare food. The Vendors are solely responsible for the preparation, quality, safety, and packaging of all food and beverage items ("Orders"). We facilitate the transaction and delivery of these Orders.
2. User Accounts
2.1. Registration: To use the Service, you must create a user account. You agree to provide accurate, current, and complete information during the registration process, including your name, valid IIT Mandi hostel/building address, room number, and phone number.
2.2. Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify MandiKart immediately of any unauthorized use of your account.
2.3. Eligibility: You must be a student, faculty member, staff, resident, or authorized visitor of IIT Mandi to use this service.
3. Ordering and Payment
3.1. Placing Orders: By placing an order through MandiKart, you are making an offer to purchase the selected items from the Vendor. An order is confirmed only when you receive a confirmation notification from us.
3.2. Pricing: All prices listed on the platform are determined by the Vendors. Prices are listed in Indian Rupees (INR). In addition to the item price, your total may include delivery fees, taxes, and other applicable charges, which will be clearly displayed before you confirm your order.
3.3. Payment: Payment must be made at the time of ordering through the available payment gateways (e.g., UPI, Debit/Credit Card, Net Banking). All payments are processed by a secure third-party payment processor.
3.4. Order Availability: All menu items are subject to availability. The Vendor may reject an order or part of an order if an item is unavailable. In such cases, you will be notified, and a refund for the unavailable item will be processed.
4. Delivery
4.1. Delivery Time: We provide an estimated delivery time, but this is not a guarantee. Delivery times can be affected by Vendor preparation time, weather conditions, campus events, and other unforeseen factors.
4.2. Delivery Address: You are responsible for providing a complete and accurate delivery address within the IIT Mandi campus (e.g., Hostel Name, Block, Room Number, or specific building name). MandiKart is not responsible for delivery failures or delays resulting from an incorrect address.
4.3. Receiving the Order: You must be available to receive the order at the specified delivery address. Our delivery personnel will attempt to contact you. If you are unreachable, the delivery personnel may leave the order at a designated safe spot (e.g., hostel security desk, common room) if possible, or the order may be cancelled without a refund.
5. Cancellations and Refunds
5.1. Cancellations by User: You may be able to cancel an order only before the Vendor has accepted it. Once the Vendor accepts the order and begins preparation, cancellation is not possible. The cancellation window will be specified on the order screen.
5.2. Refunds: Refunds will be considered in the following cases: * The wrong item was delivered. * The order was cancelled by the Vendor or MandiKart. * Significant quality issues with the food (subject to verification).
5.3. Refund Process: To request a refund, you must contact MandiKart support within a reasonable time (e.g., 2 hours) of receiving your order, providing your order ID and photographic evidence of the issue. All refund decisions are at the sole discretion of MandiKart. Approved refunds will be processed to the original payment method within 5-7 business days.
6. Vendor Responsibility
6.1. Food Quality and Safety: Vendors are solely responsible for complying with all applicable laws and regulations regarding food preparation, quality, hygiene, and safety.
6.2. Menu Information: Vendors are responsible for the accuracy of their menu information, including item names, descriptions, prices, and allergen information. MandiKart does not verify and is not responsible for the accuracy of this information. If you have specific allergies or dietary restrictions, please contact the Vendor directly before placing your order.
7. User Conduct
You agree not to:

Use the Service for any unlawful purpose.

Provide false or misleading information.

Harass, abuse, or harm our delivery personnel, Vendor staff, or other users.

Attempt to gain unauthorized access to our systems or engage in any activity that disrupts the Service.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. MandiKart does not warrant that the Service will be uninterrupted or error-free. We disclaim all liability for the acts, omissions, or conduct of any Vendors, delivery personnel, or other third parties in connection with the Service. Your sole remedy against MandiKart for dissatisfaction with the Service is to stop using the Service.
9. Limitation of Liability
To the fullest extent permitted by law, MandiKart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. In no event shall MandiKart's aggregate liability for all claims related to the Service exceed the total amount you paid for the specific order giving rise to the claim.
10. Changes to Terms
MandiKart reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website or app. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mandi, Himachal Pradesh.
